Rogers Towers’ Environmental attorneys work with industrial and commercial clients, developers and real property buyers, sellers and lenders to resolve environmental issues. That assistance includes providing compliance advice about clients' operations, resolving environmental issues impacting transactions, handling agency enforcement actions, participating in multi-party negotiations and litigation for Superfund sites and representing clients in private and governmental cost recovery actions, together with related agency investigations and proceedings.
Our attorneys manage cases involving environmental torts, which blur the distinction between toxic tort litigation and environmental litigation, involving economic and cleanup damages from alleged contamination of air, soil, groundwater, and surface water. We are routinely involved in claims of subsurface soil and groundwater contamination arising from a variety of activities; such claims are related to use, handling, storage and disposal of petroleum products, hazardous substances and wastes and other toxic chemicals.
We also work with clients on a variety of water related problems, such as wetland mitigation and enforcement, permits for consumptive use of water, dock and marina permits and control, treatment and discharge of stormwater. In addition, we defend air pollution cases, asbestos cases and indoor air quality, including mold matters. Providing advice and assistance to our clients on their environmental concerns requires an understanding of toxicology, hydrogeology, epidemiology, air modeling, and various other disciplines.
