The City of Jacksonville has enacted Ordinance 2013-94-E, granting a partial waiver of mobility fees for 18 months. The ordinance applies to both residential (single family and multifamily; existing lots and new development) and non-residential development, and waives a portion of the mobility fees that would otherwise be due in connection with the project.
In order to benefit from the waiver, the property owner/developer must apply to the City for “full” Mobility Fee Calculation Certificate review, which calculates all credits for which the project is eligible. (This is as opposed to Expedited Mobility Fee Calculation Certificate review, which does not calculate a project’s mobility fee credits.) Upon issuance of the Mobility Fee Calculation Certificate, the property owner/developer must proceed in accordance with the applicable provisions below:
Residential Development – Existing Lots
A building permit for single family residential construction on an existing lot that is obtained:
- By January 19, 2014, shall pay 25% of the mobility fee set forth in the Mobility Fee Calculation Certificate;
- Between January 20, 2014 and July 19, 2014, shall pay 50% of the mobility fee set forth in the Mobility Fee Calculation Certificate; and
- Between July 20, 2014 and October 19, 2014, shall pay 75% of the mobility fee set forth in the Mobility Fee Calculation Certificate.
Failure to obtain a certificate of occupancy for the house by October 19, 2016 shall require payment of the waived mobility fee amount.
Single Family Residential – New Subdivision
If a site clearing permit for property that has received 10-set engineering plan approval pursuant to the Jacksonville Code of Subdivision Regulations (Chapter 654) is obtained:
- By January 19, 2014, any future building permit for single family construction on that property shall pay 25% of the mobility fee set forth in the Mobility Fee Calculation Certificate;
- Between January 20, 2014 and July 19, 2014, any future building permit for single family construction on that property shall pay 50% of the mobility fee set forth in the Mobility Fee Calculation Certificate; and
- Between July 20, 2014 and October 19, 2014, any future building permit for single family construction on that property shall pay 75% of the mobility fee set forth in the Mobility Fee Calculation Certificate.
Failure to obtain a certificate of occupancy for a single family residential building permit in the subdivision by October 19, 2016 shall require payment of the waived mobility fee amount.
Non-Residential and Multifamily Development
Projects receiving approval of final construction and/or engineering plans under Chapter 320, or obtaining non-single family residential building permits:
- By January 19, 2014, shall pay 25% of the mobility fee set forth in the Mobility Fee Calculation Certificate;
- Between January 20, 2014 and July 19, 2014, shall pay 50% of the mobility fee set forth in the Mobility Fee Calculation Certificate; and
- Between July 20, 2014 and October 19, 2014, shall pay 75% of the mobility fee set forth in the Mobility Fee Calculation Certificate.
Final construction and/or engineering plans or non-single family residential building permits that exceed a value of $1,000,000 must be completed and a certificate of occupancy obtained no later than April 19, 2016. Final construction and/or engineering plans or non-single family residential building permits that have a value of $1,000,000 or less must be completed and a certificate of occupancy obtained no later than 12 months after the approval date of such final construction and/or engineering plans or non-single family building permits. Failure to meet these deadlines shall require payment of the waived mobility fee amount. In determining the value of a project for purposes of identifying which completion timeline applies, the project value may include all phases of development associated with the final construction and/or engineering plans or non-single family residential building permits.
